Friday, June 12, 2015
Michael Merritt, Of Counsel at McCormick Barstow, obtained a favorable verdict in defense of a high exposure auto accident case on June 3, 2015. The Plaintiff, a relatively young man at 43 years of age, embarked on a course of medical care which resulted in a 2-level lumbar fusion surgery after an auto accident, which occurred on March 3, 2010. The Plaintiff also claimed he was still in severe pain and would need a future implant of a spinal cord stimulator.
The Plaintiff sought over $3 million from the jury in damages. After one and a half weeks of trial, the jury determined that the Plaintiff had not required a fusion surgery or a long course of pain management treatment as a result of the auto accident. The jury awarded the Plaintiff a total of $30,000 for past medical expenses and general damages, and made no award of future medical care or general damages.
