MCCORMICK BARSTOW LLP ATTORNEYS CONTRIBUTE TO NEW LEGAL TREATISE ON NEIGHBOR DISPUTES
Fresno, CA (February 19, 2013) –McCormick, Barstow, Sheppard, Wayte & Carruth, LLP attorneys Todd W. Baxter, Jay A. Christofferson and Daniel E. Witte are contributing authors of a new legal treatise entitled “Neighbor Disputes: Law and Litigation.” The book, published in January of 2013 by Continuing Education of the Bar (“CEB”), is designed the help lawyers successfully handle the most common to the most complex neighbor disputes.
Mr. Christofferson and Mr. Witte co-wrote a chapter entitled “Solar and Wind Energy Development and Use.” The chapter discusses, among other things, laws regulating the installation of wind and solar energy collection systems and the handling of disputes arising out of those systems.
Mr. Baxter wrote two chapters for the book. The first covers common causes of action in neighbor disputes, such as Nuisance, Trespass, Civil Harassment and Slander of Title. The second chapter addresses remedies that are commonly available in neighbor disputes, such as Attachment, Forcible Entry and Forcible Detainer, Injunctive Relief and Declaratory Relief.
Besides the chapters discussed above, the book contains 15 other chapters covering a wide range of neighbor disputes such as Easements, Tree-Related Disputes, Domestic Animals, Criminal Activities, Water Rights, Toxic Torts and Earth Movement: Landslide, Subsidence, and Drainage. Disputes involving noise, odor and light, as well as issues involving light, air, views and open space are also covered in this wide-ranging legal treatise.
Mr. Baxter is a partner with McCormick Barstow LLP, where he is the chairman of the Appellate Law Group for the firm. He received his Bachelor of Science degree from the University of Wisconsin, and his Juris Doctorate degree from the University of Nebraska College of Law. Mr. Baxter specializes in appellate litigation and has been certified by the State Bar of California Board of Legal Specialization as a specialist in Appellate Law. Mr. Baxter also practices insurance coverage and insurance bad faith litigation.
Mr. Christofferson is also a partner with McCormick Barstow LLP. He received his Bachelor of Science degrees from the University of California at Santa Barbara and his Master of Science from the University of Utah. He received his Juris Doctorate degree from the University of Pacific, McGeorge School of Law. Mr. Christofferson specializes in insurance coverage, insurance bad faith, ERISA, civil litigation and subrogation matters.
Mr. Witte is of counsel with McCormick Barstow, LLP. He received his Master of Business and Bachelor of Science degrees, magna cum laude, from Brigham Young University and his Juris Doctorate degree, magna cum laude, from the Brigham Young University School of Law. Mr. Witte concentrates in insurance coverage, insurance bad faith and subrogation. Mr. Witte has been qualified as a Chartered Financial Consultant (ChFC) and Certified Life Underwriter (CLU). Mr. Witte is also a Fellow of the Life Management Institute (FLMI) His designation include Associate, Insurance Regulatory Compliance (AIRC); Associate, Reinsurance Administration (ARA); and Associate, Customer Service (ACS).
Mr. Baxter and Mr. Christofferson have also contributed to other CEB publications. Both have served as update authors for the CEB Publication, “Retail Leasing: Drafting and Negotiating the Lease.”
