Insurance Fraud and SIU Defense
Drawing upon the expertise and skills of attorneys from among its various practice groups, McCormick Barstow has developed a Fraud and SIU Defense Team devoted to the investigation, analysis and litigation of suspicious claims. The members of this team have the specialized expertise and ability to provide coverage analysis of a suspicious claim, as well as the ability to recognize and analyze related non-fraud coverage issues, and possess the trial experience needed to defend and litigate all aspects of first and third-party fraudulent claims in arbitrations and trials.
Members of the Fraud and SIU Defense Team have handled all types of fraudulent claim issues, including such specialized matters as arson and suspicious property loss claims, RICO, Qui Tam and other recovery actions, fraud rings and other large scale fraud activity, fraudulently obtained insurance policies and premium ratings, workers compensation fraud, life, accident and disability fraudulent claims, fraudulent personal injury accident claims and inflated and unreasonable UM/UIM and medical payments claims, and evaluation of potential fraud involving medical provider billings, attorneys’ fees claims and related investigations.
Members of the Fraud and SIU Defense Team have conducted literally thousands of depositions and examinations under oath, have conducted bench and jury trials and are familiar with all methods of evaluating, litigating and resolving suspected claims, as well as the necessity of complying with statutory and governmental regulatory requirements. The members of this team have also been retained and have testified effectively in trials as expert witnesses regarding such matters as claims handling and investigation, complex coverage issues, advice of counsel, and refuting bad faith allegations concerning denial of fraudulent claims.
The firm’s reputation and experience are reflected in its clientele and the frequent appearances of its attorneys as authors and lecturers on fraud and related insurance coverage topics. Members of the team contributed chapters on “When a Loss Occurs: Conditions and Duties” and “SIU and the Role of Counsel During Investigation” to California Property Insurance: Law & Litigation, a practice guide published by the Continuing Education of the Bar. Members have also contributed to Bad Faith and Punitive Damages: Annotations to First Party Insurance Cases, Statutes, and Regulations published by the American Bar Association’s Property Insurance Law Committee. Team attorneys lecture extensively on fraud and related insurance coverage topics for bar associations, clients and industry groups including, but not limited to, Property Loss Research Bureau/Liability Insurance Research Bureau, Defense Research Institute, Association of Defense Counsel of Northern California, ABA Property Insurance Law Committee, California Conference of Arson Investigators, Northern and Southern California Fraud Investigators Associations, Western States Auto Theft Investigators, Combined Claims Conference, Claims Conference of Northern California, California Association of Independent Insurance Adjusters, and various other groups. Members regularly train and certify adjusters, investigators and others on applicable Special Investigations Unit and claims handling regulations and provide clients with in-house training on all relevant topics.
